Welcome to flightinsight (the “Site”), operated by Gordon Schoenfeld (“we,” “us”). These Terms of Use govern your access to and use of the Site. By visiting or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
1. What the Site is
The Site is a flight-search and visualization tool. It queries third-party data sources and displays flight options on a time-axis chart, including pricing and, where available, frequent-flyer award-value estimates. flightinsight is not a travel agency, does not sell tickets, and does not facilitate bookings. Any ticket purchase you make is a transaction between you and the airline or other third party, and we are not a party to it.
2. Acceptable use
You agree to use the Site only for lawful, personal, non-commercial purposes. You will not:
- access, scrape, crawl, or extract data from the Site by automated means, except where we have given written permission;
- reverse engineer, decompile, or attempt to derive the source code, models, or APIs underlying the Site;
- resell, sublicense, rent, or otherwise commercially exploit the Site or its output;
- attempt to disrupt, overload, probe, or compromise the Site or its infrastructure;
- use the Site in any way that violates applicable law or the rights of any third party.
3. Intellectual property
All content, code, design, layout, branding (including the name “flightinsight” and the flightinsight logo), and other materials on the Site are owned by Gordon Schoenfeld and are protected by copyright, trademark, and other laws. You receive a limited, revocable, non-exclusive, non-transferable license to use the Site for personal, non-commercial purposes. No other rights are granted to you, by implication or otherwise.
4. Third-party data and trademarks
Flight pricing, schedule, and availability data are provided by Duffel. Award-redemption data are provided by Seats.aero. This information is supplied to us by third parties and is provided to you for informational purposes only. It may be inaccurate, incomplete, stale, or out of date, and is subject to change without notice. We make no representation or warranty regarding the accuracy, currency, or completeness of any pricing, schedule, fare, or award information displayed on the Site.
Airline names, codes, logos, and alliances referenced on the Site are trademarks of their respective owners. They appear on the Site only to identify the carrier or alliance to which a flight or offer relates and do not imply any affiliation with, endorsement by, or sponsorship by the airline or alliance.
5. No warranty
The Site is provided on an “as is” and “as available” basis without warranty of any kind, express or implied, including without limitation any warranty of merchantability, fitness for a particular purpose, non-infringement, or accuracy. Your use of the Site is at your sole risk.
6. Limitation of liability
To the maximum extent permitted by law, in no event shall Gordon Schoenfeld be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or use, arising out of or related to your use of the Site, whether based on warranty, contract, tort, statute, or any other legal theory, even if advised of the possibility of such damages. The aggregate liability arising out of or related to these Terms shall not exceed one hundred U.S. dollars ($100).
7. Indemnification
You agree to indemnify, defend, and hold harmless Gordon Schoenfeld from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Site or your breach of these Terms.
8. Termination
We may suspend, restrict, or terminate your access to the Site at any time, for any reason, without notice. Provisions of these Terms that by their nature should survive termination — including Sections 3 through 7, 10, and 11 — will do so.
9. Changes to these Terms
We may update these Terms from time to time. Material changes will be reflected by updating the “Last updated” date above. Your continued use of the Site after a change constitutes acceptance of the revised Terms.
10. Governing law
These Terms are governed by the laws of the State of California, U.S.A., without regard to its conflict-of-laws principles. Any dispute arising under or in connection with these Terms shall be resolved exclusively in the state or federal courts located in San Francisco County, California, and you consent to personal jurisdiction in those courts.
